Insphire Terms and Conditions of Trade

Arculus Holdings Limited trading as Insphire Event Rental (“Insphire”, “we”, “our”, or “us”) agrees to supply rental products to you, the Customer, in return for payment and acceptance of the following Terms and Conditions.
By hiring any goods (“Products”) from Insphire, you acknowledge you have read, understood, and accepted these Terms.

1. Orders and Hire Period

  1. You may place orders through any accepted method.
  2. Orders are subject to availability. If necessary, we may substitute similar items and will notify you.
  3. Orders cannot be cancelled without our written approval. Cancellations within 1 week of delivery may incur up to 20% fees.
  4. Hire Period begins on the Commencement Date and ends upon return or collection of the Products.

2. Pricing and Payment

  1. Prices are quoted in NZD and exclude GST unless stated otherwise.
  2. All published prices are for a one-day hire unless otherwise quoted.
  3. Quotes are valid for 14–30 business days depending on the agreement.
  4. A 50% deposit is required to confirm booking. Full payment is due before delivery, unless you hold a trade account.
  5. Trade accounts must settle invoices by the 20th of the month following hire.
  6. Credit card payments may incur a 2% surcharge. Bank payments and debit cards do not incur this fee.

3. Delivery and Collection

  1. Delivery times are approximate within a 2-hour window. Extra charges may apply for difficult access.
  2. You authorise us to access your property for delivery and collection and accept all associated risks.
  3. Products must be returned on the agreed date. Late returns may incur daily fees or replacement charges.
  4. All items must be repacked in original packaging and left in an accessible area for collection. Return visits incur extra charges.

4. Risk and Insurance

  1. Risk passes to you upon delivery or pick-up.
  2. Insurance is your responsibility during the Hire Period.
  3. You are liable for loss, damage, or breakage, including crates and packaging.
  4. You must promptly report any damage or issues.

5. Your Responsibilities

  1. Use Products safely and only for their intended purpose.
  2. Return Products in original condition (fair wear and tear excepted).
  3. Do not sublet or assign Products without written consent.

6. Returns and Inspection

  1. Check items on delivery and report discrepancies immediately.
  2. Returns are only accepted if agreed in writing, in original packaging, and in unused condition.
  3. Complaints after pick-up will not be considered.

7. Default and Enforcement

  1. If payment is not made:
  2. We may retain or repossess Products.
  3. Interest of 5% above our overdraft rate may apply on overdue balances.
  4. We may recover legal and collection costs from you.
  5. All unpaid monies become due immediately.

8. Limitation of Liability

  1. We are not liable for indirect, special, or consequential damages.
  2. Our total liability is capped at the value of the most recent invoice you paid.
  3. Consumer Guarantees Act 1993 applies unless you are in trade and waive those rights.

9. Privacy

  1. You authorise Insphire to:
  2. Collect, use, and disclose your personal or credit information for processing and enforcement purposes.
  3. Access your personal data under the Privacy Act 1993 and request corrections.

10. Ownership

  1. All Products remain the property of Insphire.
  2. You acknowledge that use of our Products does not transfer any ownership rights to you.

11. Force Majeure

  1. We are not liable for delays or failure to supply due to events beyond our control including natural disasters, supplier failure, or transport issues.

12. General

  1. These Terms are governed by New Zealand law.
  2. We may update Terms by written notice or website updates.
  3. Invalid provisions do not affect the remainder of these Terms.
  4. Notices must be in writing (email accepted).
